TERMS OF SERVICE

Last Updated: 17 August 2026

Welcome to Founsturt.

These Terms of Service (“Terms”) govern your access to and use of Founsturt.store (the “Website”) and the purchase of products made available through the Website.

Throughout these Terms, “Founsturt”, “we”, “us” and “our” refer to the business operating Founsturt.store. “You” and “your” refer to any visitor, customer or other user of the Website.

Please read these Terms carefully before using the Website or placing an order.

Nothing in these Terms affects any statutory rights that you have as a consumer under applicable UK law.

1. ABOUT FOUNSTURT

Founsturt operates an online retail store offering clothing, fashion products, accessories and related goods.

Website: Founsturt.store
Customer Support: support@Founsturt.store

Additional business and contact information is available through our Contact Information and Legal Notice pages.

2. ACCEPTANCE OF THESE TERMS

By accessing our Website, creating an account or placing an order, you agree to be bound by these Terms to the extent permitted by applicable law.

If you do not agree with these Terms, you should not use the Website to purchase products.

Your statutory consumer rights remain unaffected.

3. ELIGIBILITY

You must have the legal capacity to enter into a contract in order to make a purchase through our Website.

If you are purchasing on behalf of a business or another organisation, you confirm that you have authority to act on its behalf.

These Terms are primarily intended to govern purchases made by consumers.

4. PRODUCT INFORMATION

We take reasonable care to ensure that product descriptions, specifications, images, colours, measurements and other information displayed on our Website are accurate.

However, colours and appearance may vary slightly depending on your device, screen settings, lighting and other technical factors.

Product images may contain styling, accessories or decorative items that are not included with the product unless expressly stated in the product description.

Nothing in this section limits your statutory rights where goods are not as described or otherwise fail to conform to the contract.

5. PRODUCT AVAILABILITY

All products are subject to availability.

Adding a product to your basket does not reserve that product.

If a product becomes unavailable after you place an order, we will contact you and, where appropriate, cancel the affected product or order and provide any refund due.

We will not substitute a materially different product without your agreement.

6. PRICES

Prices displayed on the Website will be shown clearly before you place your order.

Any applicable taxes and mandatory charges will be presented in accordance with applicable law.

Delivery charges, where applicable, will be disclosed before you complete your purchase.

We may change product prices from time to time. Changes will not retrospectively alter the agreed price of an order for which a binding contract has already been formed, except where permitted or required by law.

7. PROMOTIONS AND DISCOUNTS

From time to time, Founsturt may offer promotional prices, discount codes, bundles or other special offers.

Any specific conditions applicable to a promotion will be made clear to customers.

Promotional claims, reference prices and discounts will be presented in accordance with applicable consumer protection law.

Unless otherwise stated, promotional codes cannot be exchanged for cash.

Promotions do not affect your statutory consumer rights.

8. PLACING AN ORDER

To place an order, select the products you wish to purchase, add them to your basket and follow the checkout process.

Before submitting your order, you will have an opportunity to review the information provided and correct relevant errors.

You are responsible for ensuring that the information you provide is complete and accurate.

The checkout process will make clear when placing the order creates an obligation to pay.

After you submit an order, we will provide an electronic confirmation.

9. FORMATION OF THE CONTRACT

Submitting an order does not necessarily mean that we have accepted it.

A binding contract will be formed when we accept your order, which may occur when we send an order acceptance or dispatch confirmation, depending on the information provided during checkout.

If we cannot accept your order, we will inform you and will not charge you for products we do not supply. Where payment has already been taken, any amount due will be refunded.

10. REFUSAL OR CANCELLATION OF ORDERS

We may refuse or cancel an order where we have a legitimate reason to do so, including where:

  • the product is unavailable;

  • payment cannot be authorised;

  • information supplied for the order is materially incomplete or incorrect;

  • we reasonably suspect fraud or unauthorised activity;

  • applicable legal or regulatory requirements prevent us from completing the order; or

  • there is an obvious pricing or product information error which could reasonably have been recognised as such.

We will not exercise these rights arbitrarily or in a manner that unlawfully limits your consumer rights.

Where an order is cancelled and payment has already been received for goods that will not be supplied, an appropriate refund will be issued.

11. PAYMENT

Available payment methods will be displayed during checkout.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

Payment processing may be carried out by third-party payment providers.

You must pay the total amount displayed and agreed at checkout.

We will not add optional charges without obtaining the consent required by applicable law.

12. DELIVERY

Available delivery methods, applicable charges and relevant delivery information will be displayed on the Website or during checkout.

You must provide an accurate and complete delivery address.

We will deliver your order within the timeframe agreed with you. Where no different delivery period has been agreed, applicable statutory delivery requirements will apply.

Delivery estimates may be affected by circumstances outside our reasonable control. Where a material delay occurs, we will handle the matter in accordance with applicable consumer law.

For further information, please see our Shipping Policy.

13. DELIVERY PROBLEMS

Please contact us if your order has not arrived within the expected delivery period or if you believe it has been lost or materially delayed.

We will investigate the matter with the relevant delivery provider where appropriate.

Nothing in these Terms transfers to you any risk that the law requires us to retain.

14. RISK AND OWNERSHIP

Risk in goods will pass in accordance with applicable consumer law.

Where we arrange delivery to a consumer, we remain responsible for the goods as required by law until the relevant legal requirements for transfer of risk have been satisfied.

Ownership of the goods will pass to you in accordance with the applicable contract and legal requirements.

15. RIGHT TO CANCEL

Consumers purchasing goods online may have a statutory right to cancel their contract without giving a reason.

For many online purchases of goods, the cancellation period expires 14 days after the day on which you, or a person nominated by you other than the carrier, acquires physical possession of the goods, subject to the applicable rules and exceptions.

If multiple goods forming one order are delivered separately, different rules may determine when the cancellation period begins.

Full information about exercising your cancellation rights is provided in our Return & Refund Policy.

16. RETURNS AND REFUNDS

Returns, cancellations and refunds are governed by our Return & Refund Policy and applicable UK consumer law.

Our Return & Refund Policy forms part of the information governing purchases made through Founsturt.

Nothing in these Terms or our Return & Refund Policy excludes or restricts statutory rights that cannot lawfully be excluded or restricted.

17. FAULTY OR NON-CONFORMING GOODS

Goods supplied by Founsturt must comply with applicable consumer law.

Where applicable, goods must be:

  • of satisfactory quality;

  • fit for their intended or agreed purpose; and

  • as described.

If a product is faulty, damaged, misdescribed or otherwise does not conform to the contract, you may have statutory remedies under the Consumer Rights Act 2015.

Depending on the circumstances, these may include rights relating to rejection, repair, replacement, price reduction or refund.

Contact support@Founsturt.store if you believe that a product does not conform to the contract.

18. INTELLECTUAL PROPERTY

Unless otherwise stated, the Website and the material made available through it, including our branding, original graphics, website design, text, photographs and other original content, are owned by or licensed to Founsturt and are protected by applicable intellectual property laws.

You may use the Website for lawful personal and non-commercial purposes.

You must not reproduce, distribute, modify, commercially exploit or otherwise use protected Website content without permission where such permission is legally required.

Nothing in these Terms claims ownership over intellectual property belonging to third parties.

19. ACCEPTABLE USE

You must not misuse the Website.

You must not knowingly:

  • use the Website for unlawful or fraudulent purposes;

  • attempt to obtain unauthorised access to the Website or associated systems;

  • knowingly introduce malicious code, viruses or other harmful material;

  • interfere with the proper operation or security of the Website;

  • impersonate another person for fraudulent purposes;

  • submit deliberately false information in connection with fraudulent activity; or

  • use the Website in a manner that infringes the rights of another person.

We may take reasonable action to protect the Website, our customers and our business from unlawful or abusive activity.

20. CUSTOMER ACCOUNTS

Where customer accounts are available, you are responsible for keeping your login credentials confidential and for providing accurate account information.

Please notify us promptly if you reasonably believe that your account has been accessed without authorisation.

We may suspend or restrict an account where reasonably necessary for security, fraud prevention or legal compliance.

21. THIRD-PARTY SERVICES

The Website may use third-party providers for services such as payment processing, hosting, analytics, logistics or other operational functions.

Where third-party links are provided for convenience, we do not control independent third-party websites.

Nothing in this section excludes responsibility that cannot legally be excluded.

22. WEBSITE AVAILABILITY

We aim to keep the Website available and functioning properly, but we cannot guarantee uninterrupted availability at all times.

We may temporarily suspend access for maintenance, security, technical improvements or circumstances outside our reasonable control.

Where possible, we will seek to minimise disruption.

23. LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence where liability cannot lawfully be excluded;

  • fraud or fraudulent misrepresentation; or

  • any other liability that cannot be excluded or restricted under applicable law.

Nothing in these Terms limits the statutory remedies available to consumers for goods that do not conform to the contract.

For consumer purchases, we are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law.

We are not responsible for losses that were not reasonably foreseeable or for business losses arising from a purchase made wholly for personal consumer purposes, to the extent permitted by law.

24. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for a failure or delay caused by circumstances outside our reasonable control to the extent permitted by law.

Where such circumstances materially affect our ability to perform the contract, we will take reasonable steps to minimise their impact and communicate with affected customers where appropriate.

Your statutory rights remain unaffected.

25. PRIVACY AND PERSONAL DATA

Personal information collected through the Website will be handled in accordance with our Privacy Policy and applicable data protection law.

Please review our Privacy Policy for information about how we collect, use, retain and otherwise process personal information.

26. ELECTRONIC COMMUNICATIONS

When you place an order or provide contact information, we may send transactional communications necessary to administer your purchase, including order confirmations, payment information, delivery updates and customer service communications.

Marketing communications will be handled separately and subject to applicable consent and direct marketing requirements.

27. REVIEWS AND CUSTOMER CONTENT

Where the Website allows customers to submit reviews, photographs or other content, such content must be genuine and must not be unlawful, fraudulent, defamatory or infringe third-party rights.

We will not knowingly publish or commission fake consumer reviews.

We may moderate content where reasonably necessary to enforce these requirements or comply with law.

28. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Website, services or applicable legal requirements.

The version applicable to an order will generally be the version in effect when the relevant contract was formed, unless a change is required by law or otherwise validly agreed.

The latest version will be displayed on Founsturt.store with its updated date.

29. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.

30. NO WAIVER

If we do not immediately enforce a provision of these Terms, this does not necessarily mean that we have waived our right to enforce it later.

31. THIRD-PARTY RIGHTS

Unless expressly stated otherwise or required by law, these Terms are between you and Founsturt and are not intended to give contractual rights to another person.

32. GOVERNING LAW AND JURISDICTION

These Terms and contracts for purchases through Founsturt.store are governed by applicable UK law.

If you are a consumer, nothing in these Terms deprives you of any mandatory protections or rights available to you under the law applicable to you.

Any dispute will be handled by courts having jurisdiction under applicable law. Nothing in this section unlawfully restricts a consumer's right to bring proceedings in a court that has jurisdiction over their claim.

33. CONSUMER PROTECTION

These Terms are intended to operate consistently with applicable UK consumer protection legislation, including where relevant:

  • the Consumer Rights Act 2015;

  • the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; and

  • the Digital Markets, Competition and Consumers Act 2024.

Nothing in these Terms excludes, restricts or modifies statutory rights where doing so would be unlawful.

If a provision of these Terms conflicts with a mandatory requirement of consumer law, the mandatory legal requirement will prevail.
